Welcome to Stay Fueled! By using our services, you agree to the following Terms of Service.
Please read them carefully.

**1. Acceptance of Terms**

By subscribing to our fuel delivery service, you agree to these Terms of Service.
If you do not agree, please DO NOT sign up.

**2. Services Provided**

Stay Fueled provides subscription-based fuel delivery to residential and commercial customers.
Our services include:

* Scheduled fuel deliveries based on your selected plan.

* Competitive fuel prices in your area.

**3. Subscription Plans**

We offer various subscription plans to meet your fuel needs. Details on pricing, delivery frequency,
and terms for each plan are available on our website/app. All subscriptions are billed regularly as
outlined in your chosen plan.

**4. Payment Terms**

By subscribing, you authorize Stay Fueled to charge your payment method for your selected subscription, which includes a $75 start-up fee and a 3-month guarantee. Payments are due on the date specified in your subscription agreement. Late payments may incur additional fees.

**5. Delivery Policies**

Stay Fueled delivery times and dates will be communicated through the Stay Fueled app. Please ensure 

a clear and unobstructed delivery path for your delivery. If your vehicle is inaccessible, a $15 charge 

will be added to your account. Stay Fueled reserves the right to reschedule deliveries due to unforeseen circumstances like severe weather, equipment malfunctions, or accidents.

**6. Cancellations and Refunds**

You may cancel your subscription after your 3-month contract by contacting us via our app, email, 

or phone. A 30-day notice is required to cancel for free; cancellations without notice will incur a $50 fee. Refunds will be processed according to your subscription agreement. Please refer to our separate 

cancellation policy for full details.

**7. Customer Responsibilities**

As a subscriber, you agree to:

- Provide accurate and current delivery and payment information.

- Notify us of any changes to your delivery requirements or contact details.

**8. Limitation of Liability**

Stay Fueled is not liable for any indirect, incidental, or consequential damages arising from service use or disruptions. Please note that all delivery services are subject to recording for social media marketing, training, and safety. All recordings are secure, and personal information will not be released unless legally required. If you believe your vehicle was damaged during a Stay Fueled delivery, an immediate review 

will be conducted, including:

- A full review of the fuel delivery recording.

- A fuel tank review for pollutants on both the Stay Fueled truck and your vehicle.

- An inspection of your vehicle by a Stay Fueled-selected certified mechanic.

**9. Modifications to Terms**

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any modifications indicates your acceptance of the revised terms.

**10. Governing Law**

These Terms of Service are governed by and construed by the laws of St. Johns County, Florida. 

Any disputes will be resolved in the courts of St. Johns County.

CANCELLATION POLICY

**Effective Date:** August 2025

At Stay Fueled, we aim to provide the best mobile fuel delivery service. We understand that plans can change, and our cancellation process is designed to be straightforward. Please review our cancellation policy below:

**1. Cancellation Window**

You may cancel your fuel delivery order without penalty up to 2 hours before the scheduled delivery time. Cancellations made after this window may incur a $5 cancellation fee.

**2. Cancellation Fee**

A $5 cancellation fee will be charged to cover operational costs if a cancellation occurs within
1 hour of the scheduled delivery time.

**3. How to Cancel**

To cancel your order, please contact Judd or Molly at 904-501-4909, email us at judd@stafueled.com
or molly@stayfueled.com, or use our app. Please provide your order number and cancellation details.

**4. Refunds**

Refunds, when applicable, will be credited to your original payment method within 7-10 business days.

**5. Exceptions**

We understand that emergencies happen. If you believe your situation warrants an exception to this
policy, please reach out to our customer service team. As a local family business, we consider our
customers part of our family and will do our best to accommodate your needs.

**6. Policy Changes**

Stay Fueled reserves the right to update or modify this cancellation policy at any time.
We will notify customers of any significant changes via our website.
